Do you live in or rent a place where a Homeowners Association (HOA) has set rules and regulations? Have you ever checked into what those restrictions mean to you and your dog? After hearing about Bianca Raphael and her dog Chan Chan, you might want to do a double read through. Ms. Raphael lives in the Arlington area of Jacksonville, FL and has been faced with a law suit from the HOA after refusing to remove Chan Chan, her beloved and faithful canine companion. Chan Chan has been accused of biting the neighbor and the neighbor’s dog.
What HOA Says Usually Wins
According to Dale Carson, Action News Jax Law & Safety Expert if an HOA deems your dog a nuisance, despite it being anything to the contrary, it is a nuisance, and the HOA can demand that the dog is removed from living within the property. Ms. Raphael states that the neighbor and her dog were in violation of the leash law, and both had entered Ms. Raphael’s home uninvited. This type of control would make any reasonable pet owner want to think about moving into an HOA. If you love your pet and are prepared to move at a moment’s notice great, but if not then you might steer clear from any HOA.
Painting a Brighter Canvas
It’s really sad that the HOA is resorting to such extreme measures and not looking for an alternative solution. Jacksonville is growing in popularity and is making a difference with pet ownership and saving the lives of animals in shelters. Having the cooperation of HOA’s and other living facilities where people can have dogs is imperative to the continued success. Solutions to the problem might be requiring Chan Chan to attend a basic dog obedience class and then acquire his Canine Good Citizen certification. If the dog’s owner is unable to do that, then ask the dog to leave, but don’t automatically resort to a drastic measure. That’s why change never occurs. People want to remove a problem rather than fix the problem.
Taking the time to review and discuss a solution can be beneficial to all parties.
