District Attorney George Brauchler praised Ashleigh Banfield of CNN of her coverage of the Aurora Theater attack in an interview that she conducted with him on Aug 28, 2015. He praised her for “covering this case the way [she] did”. The way that she covered the case was (in Brauchler’s benefit) to miss several of the most important aspects of the case and trial.
The first aspect of the case that Ashleigh Banfield missed was that DA Brauchler lied throughout the case. DA Brauchler claimed James Holmes stopped shooting because Holmes’ assault rifle jammed, even though after the jam, Holmes simply switched over to shooting with his handgun. He shot a few shots with the pistol and walked out of the theater with a working, partially loaded handgun. Then once outside, he even cleared the jam of the assault rifle. He then put down the assault rifle and waited by the car to be arrested. James Holmes clearly did not stop shooting because his gun jammed and Brauchler knew it but lied anyway. Ashleigh Banfield didn’t even ask DA Brauchler about the lies and why he lied in order to get a jury to execute someone.
Banfield thanked DA Brauchler for his services in the courtroom even though the courtroom wasn’t necessary because the defense had already agreed long before the trial to the sentence that Holmes eventually, after much cost, received. DA Brauchler has claimed that he didn’t accept the deal because he wanted the contents of the notebook. However the defense would have given the same deal after Dr. Metzner had gotten ahold of the notebook and interviewed Holmes finding his sane. Had Metzner, like most of the psychiatrists involved in this case, found Holmes insane, the deal would have been much in favor to Holmes. Ashleigh Banfield didn’t point out the risk that Brauchler took putting the case in the hands of Metzner during CNN’s coverage of the trial and the subsequent interviews of DA Brauchler.
Judge Samour pointed out on the record that the victims were able to give their stories during the trial. He however didn’t point out that the stories were directed by DA Brauchler for his benefit, not theirs, and none of them were complete partially due to defense objections. The money wasted on the trial could have easily been spent on a museum benefiting the victims filled with the recordings of the victims telling as much of their story as they wanted with no interruption from the defense. Also the plea bargain could have been accepted after Dr. Reid had interviewed Holmes and the entire recording of those sessions and the notebook could have been a major draw to the museum. Ashleigh Banfield, CNN and many others benefited greatly from the public disclosure during the trial of the notebook and Holmes interview. The victims did not. Ashleigh Banfield didn’t report any of this during her coverage of the trial and its aftermath.
The DA discussed with Ashleigh Banfield that James Holmes had a game face in which he would act more reserved in the courtroom in front of the jury than when they were not present. But the DA and Banfield both must know that defense attorneys tell their clients to be neutral in front the jury. However most defendants can’t be as unemotional as James Holmes was during the trial. The DA during the trial missed by Banfield also pointed out that Dr. Woodcock refused to call back the jail doctor about Holmes mental condition and both should know that Woodcock’s observations at the time was work product and can’t by law be discussed with people such as the jail doctor.
One of the primary themes of the interview dealt with how DA Brauchler dealt with the gut wrenching exhibits and testimony, but DA Brauchler was clearly focused on killing Holmes and Brauchler exhibits signs of psychopathy. Brauchler lies even though he knows he will be caught. The Judge specifically warned him to not slip improper things into his slides and he did it anyway. Brauchler’s entire case wasn’t about the facts but it was intended to manipulate the jury into killing Holmes. The way Brauchler used the most damaged victims merely as bookends to his case was chilling. He put Caleb Medley, who is brain damaged, at the beginning of the case and put Ashley Moser, who has been paralyzed, at the end. Banfield pointed out Moser’s testimony but not in the testimony’s placement in the trial. The defense was not ready at the end of the prosecution’s case and had planned
a midweek start so the trial was placed on hiatus for three days. In those three days the DA could have easily allowed other victims that didn’t get a chance to testify but he didn’t. He clearly wanted Moser as a bookend and he left her as a bookend. During the trial Brauchler played a game of “insert victim here” which was not to inform the jury but just to manipulate them to execute Holmes. The prosecution in order to get the victim pawns to fit into the trial, they actually had to cut some of the victims off from telling their story. Most of the victims got to show their positions on a model of the theater but one victim was forced to just hold up and point on a diagram because of a lack of time in adhering to the script. During his closing, Brauchler used the victim’s autopsy photos in such a way as beyond belief. He flashed them on the screen in a macabre “before and after” series of segments. Ashleigh Banfield did not ask Brauchler about any of this abuse of victims by Brauchler.
Ashleigh Banfield thanked Brauchler for “taking the time” for the interview seemingly unaware of Brauchler’s intention to run for the Senate in the state of Colorado. Brauchler has been doing many interviews to further that aim and none of the so called reporters interviewing him have even asked the basic questions. William C Holden of the local Denver Fox affiliate TV station KDVR even solicited questions for Brauchler on twitter and was given many of the aspects mentioned in this story to ask but the person doing the interview didn’t apparently ask a single one. All of the media that Brauchler dare give access to him ask almost the same questions and none which are the most important aspects of the Aurora Theater attack case. Brauchler has repeatedly turned down offers to debate anyone who knows about this case.
The three main aspects of the case missed were DA Brauchler’s numerous lies to the jury in order to get them to execute Holmes, what Holmes was working with in Dell’Acqua’s lab, and the involvement in the Aurora Theater attack of Iranian terrorist Mohammad Arianfar. Mohammad Arianfar has even written a book “Omnipotent MO” about his involvement.
